MAREA PROPERTIES with address at Avenida Huayacan, Edificio Corner Center, 5th Floor, Office 508, Benito Juárez, Cancún, Quintana Roo, Mexico, ZIP Code 77533, is responsible for the processing and protection of your personal data in compliance with the provisions of Article 16, paragraph 2, of the Political Constitution of the United Mexican States, as well as the Federal Law on Protection of Personal Data Held by Private Parties and its corresponding Regulations. We make available this Privacy Notice (the “Privacy Notice”) to inform you how we collect, transfer, and use personal data. The privacy and security of your information are of utmost importance to us.
GENERAL
“MAREA PROPERTIES,” in compliance with said regulations, provides this Privacy Notice so that the Holder of personal data may exercise their right to informational self-determination.
This Privacy Notice is available to the Holders on the website of “MAREA PROPERTIES,” whose domain is: www.mareaproperties.com.mx.
You (hereinafter referred to as the “Holder” or the “Holders,” as applicable), by entering and using the Internet Page, declare that you understand and accept all the clauses contained in this Privacy Notice and expressly declare and grant your acceptance and consent for such purposes by using electronic means, in accordance with the provisions of Article 1803 of the Federal Civil Code.
If the Holder does not absolutely and completely accept all the clauses of this Privacy Notice, they must refrain from providing any type of personal data or information to “MAREA PROPERTIES” by any means, including the Internet Page.
The Holder’s absolute and express acceptance of the Privacy Notice published by “MAREA PROPERTIES” on the Internet Page shall be deemed at the very moment the Holder provides their personal data to “MAREA PROPERTIES” and/or at the moment this Privacy Notice is accessed or made available.
In order to protect the Holders against fraud, misuse, or theft of their personal information, “MAREA PROPERTIES” implements the necessary internal actions and policies, both technical and administrative, to maintain the security of the databases it maintains regarding the Holders. These files are under limited control and access in order to safeguard the information relating to the Holders in its possession. The data requested upon entering the offices or branches of “MAREA PROPERTIES” will be stored in various databases in physical and electronic formats, in order to provide access badges and maintain control over the entry and exit of those visiting its facilities, which is part of the security and protection measures adopted within the organization. The data requested from visitors will be kept in physical format for a period of 3 (three) years from the moment they were obtained. Additionally, the employees and collaborators of “MAREA PROPERTIES” have signed confidentiality agreements and the respective Privacy Notices and are informed about the scope of the protection and security of the personal data provided by the Holders, contributing to their compliance and effectiveness.
In the event that security breaches occur at any stage of processing that significantly affect the proprietary or moral rights of the Holders, they will be informed by email immediately, so that such Holders can take the corresponding measures to defend their rights, releasing “MAREA PROPERTIES” from any liability if the breach is not attributable to it. Likewise, “MAREA PROPERTIES” and those third parties involved in any phase of personal data processing shall maintain confidentiality regarding such data, an obligation that shall survive even after their relationships with the Holder or, as the case may be, with “MAREA PROPERTIES,” end.
In the absence of error, fraud, bad faith, or any other defect of will that could nullify the validity of this instrument, the interested party agrees to be subject to the provisions of this Privacy Notice.
1. Personal Data Collected
We may collect the following categories of personal data:
• General Information: Full name, gender, address, nationality, marital status, place of birth, email address, telephone number, among others.
• Financial Information: Credit/debit card data or other payment methods, tax data and bank account number, and/or CLABE number, exclusively to comply with contractual and/or commercial obligations with each of the Holders.
• Stay Details: Check-in and check-out dates, room preferences, special requests.
• Digital Information: IP address, browser type, geolocation data, device identifiers.
• Communications: Call recordings, text messages, or emails exchanged with our staff.
• Document Copies: Federal Taxpayer Registry, Unique Population Registry Code, Immigration Form, official photo ID, birth certificate, proof of address, among others.
2. Primary Purposes of Personal Data Processing.
We use your personal data to:
• Service Provision: Manage reservations, process payments, provide lodging services and customer service.
• Service Improvement: Conduct satisfaction surveys, statistical analyses, and market studies.
• Marketing and Promotions: Send you offers, promotions, and news related to our services, provided that you have given your consent.
• Security and Protection: Ensure the safety of our facilities and our guests.
• Legal Compliance: Comply with applicable legal obligations and respond to requests from competent authorities.
• Databases: Store in different databases, in physical or electronic format, the information of customers or prospects who contact “MAREA PROPERTIES” by phone, email, or social networks, in order to inquire about the marketed products and/or services; these records will be stored for a term of 3 (three) years from the time they are obtained, provided that commercial operations with “MAREA PROPERTIES” are not concluded.
• Suppliers: Contact by phone, email, or social networks to request or follow up on information requests, products and/or services, payments, or any other situation arising from the services required by “MAREA PROPERTIES,” as well as register them in the accounting system used by “MAREA PROPERTIES,” for access to personal data by authorized persons.
3. Secondary Purposes of Personal Data Processing.
a. Generate internal reports on the services provided by “MAREA PROPERTIES.”
b. Evaluate the opinion of the Holders and the quality of the services offered by “MAREA PROPERTIES.”
c. Conduct statistical studies and demographic reports with dissociated data of the Holders.
d. Mass mailings to inform about service updates offered by “MAREA PROPERTIES,” as well as promotions, commercial agreements, including important security updates.
e. Send information about the technical and administrative support services provided by “MAREA PROPERTIES.”
f. Share with business partners of “MAREA PROPERTIES,” dissociated data of the Holders.
g. Better understand the Holders and segment them with dissociated data into different groups (age, gender, preferences).

“MAREA PROPERTIES” will use your personal data always in accordance with the provisions of this Privacy Notice or its updates, which will always be available on the Internet Page.
If the Holder’s personal data is required by competent authorities as part of a legal procedure, it will be provided in compliance with the Federal Law on Protection of Personal Data Held by Private Parties, as well as any international treaties to which Mexico is a party.
5. Transfer of Personal Data
We may share your personal data with:
• Affiliated and subsidiary companies: Other companies within the Marea Properties corporate group, for purposes consistent with this privacy notice.
• Service providers: Third parties that support us in the provision of services, such as payment processors, IT services, marketing agencies, and lodging service providers.
• Legal authorities: When required by law or in response to legal proceedings.
We ensure that any third party with whom we share your personal data complies with the necessary security and confidentiality measures.

Your request must include your full name, a clear description of the right you wish to exercise, and any document that supports your request.
7. Means to Revoke Consent
The Holder of personal data may revoke the consent granted by accepting this notice. Such revocation of consent granted by electronic means must be carried out following the procedure below and using the following form to exercise your rights: [__]
• Send an email addressed to the Designated Officer in this Privacy Notice, through which such requests will be addressed.
• Send a request or message to the aforementioned email address, stating:
• The reason for your request;
• The arguments supporting your request or petition;
• An official document proving your identity and that you are who you claim to be; and,
• The date on which the revocation of your consent is to take effect.
“MAREA PROPERTIES” will notify the Holder, within a maximum of 20 (twenty) business days from the date the request for the exercise of ARCO rights is received, of the resolution adopted, so that, if appropriate, it may become effective within 15 (fifteen) business days from the date the response is communicated, through a message stating that all actions have been taken to cease processing the Holder’s personal data.
8. Means to Exercise ARCO Rights
If the Holder needs to Access, Rectify, Cancel, or Oppose the personal data provided to “MAREA PROPERTIES,” the Holder will have the following form available to exercise their rights, observing the following procedure:
9. Send an email addressed to the Designated Officer by “MAREA PROPERTIES” in this Privacy Notice, through which such requests will be addressed, stating the following:
• The Holder’s full name, address, and email address to receive the response generated as a result of your request;
• The reason for your request;
• The arguments supporting your request or petition;
• An official document proving your identity and that you are who you claim to be; and,
• A clear and precise description of the personal data for which any of the ARCO rights are to be exercised, and any other element or document that facilitates the location of the personal data.
In requests for the rectification of personal data, the Holder must also indicate the changes to be made and provide the documentation supporting their request.
“MAREA PROPERTIES” will notify the Holder, within a maximum of 20 (twenty) business days from the date the request for access, rectification, cancellation, or opposition is received, of the resolution adopted, so that, if appropriate, it may become effective within 15 (fifteen) business days from the date the response is communicated. In requests for access to personal data, the delivery will proceed upon prior verification of the identity of the requester or legal representative, as appropriate.
9. Use of “Cookies” and “Web beacons”
It is possible that the websites, digital platforms, mobile applications, or other digital environments managed by MAREA PROPERTIES (hereinafter, the “Platforms”) use “cookies” and similar technologies in connection with certain features or functions. “Cookies” are small text files that a website, application, or platform transfers to the Holder’s device (whether a computer, tablet, mobile phone, or other) to keep records, facilitate navigation, save passwords, user preferences, and enhance browsing experience.
Likewise, “web beacons” (also known as pixel tags or clear GIFs) are electronic images inserted in websites, applications, emails, or other digital environments, which may be used to monitor the Holder’s behavior, such as storing information related to their IP address, visit duration, interactions performed, type of device or browser used, among others.
Although most browsers and devices automatically accept these technologies, the Holder can choose to configure their browser or device settings to reject or delete them. However, some cookies are strictly necessary for the basic operation of the Platforms and therefore cannot be disabled.
Different types of cookies are used on our Platforms:
• Functional cookies, which allow the analysis of platform usage and improve performance.
• Social media cookies, used in content sharing buttons.
• Strictly necessary cookies, which ensure the technical functioning of the Platforms and cannot be disabled.

Limitations on Access and Disclosure of Personal Data
“MAREA PROPERTIES” is committed to making its best effort to protect the security of the personal data that the Holder is providing, by entering into legal agreements for the use of technologies that control unauthorized access, use, or disclosure of personal information; for this purpose, personal information is stored in databases with limited access located in controlled facilities with security mechanisms. “MAREA PROPERTIES” commits to treating the information provided by the Holder as confidential and using it with full privacy.
In this regard, “MAREA PROPERTIES” agrees to take the necessary measures to ensure that the processors it hires comply with the purposes established in this Privacy Notice.
Additionally, you are informed that, to avoid receiving advertising in general, you may register in the Public Registry to Avoid Advertising. For more information, you may review the website of the Federal Consumer Protection Agency.
10. Security Measures
We implement technical, administrative, and physical measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use. However, no system is completely secure; therefore, we cannot guarantee the absolute security of your information.

15. Applicable Law and Jurisdiction
The parties declare that this Privacy Notice shall be governed by the applicable legal provisions in the Mexican Republic, particularly by the Federal Law on Protection of Personal Data Held by Private Parties.
In the event of a dispute or controversy arising from the interpretation, execution, or fulfillment of this Privacy Notice and/or any of the documents derived from it or related to it, the parties will amicably seek to reach an agreement within a period of 30 (thirty) calendar days, starting from the date on which any difference arises and written notification of such event is given to the other party, by pursuing mediation proceedings before the Alternative Justice Center of the Superior Court of Justice of the state of Quintana Roo, in accordance with the Alternative Justice Law of the Superior Court of Justice of the state of Quintana Roo and its Internal Regulations in force at the time the dispute arises.
In the event that the parties do not reach an agreement, they hereby agree that all disagreements arising from this Notice and/or any documents derived from it or related to it shall be definitively submitted to the jurisdiction and laws of the Federal Administrative Authorities or Courts of the state of Quintana Roo, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.
